CONCERNING
RULES AND PROCEDURE OF VERIFICATION/TECHNICAL CHECK OF
EXPORT OF CERTAIN WOOD PRODUCTS BY SURVEYOR
THE DIRECTOR GENERAL OF FOREIGN TRADE,
Considering:
- a. that, in the framework of enforcement of the provisions of Article 9 paragraph (8) of Regulation of the Minister of Trade No. 02/M-DAG/PER/2/2006 dated February 1, 2006 on Procedure of Export of Forestry Products, it is necessary to stipulate Rules and Procedure of Verification/Technical Check of Export of Certain Wood Products by Surveyor;
- b. that, based on the considerations as meant in paragraph a, it is necessary to stipulate Regulation of the Director General of Foreign Trade;
In view of:
- 1. Regulation of the Minister of Trade No. 01/M-DAG/PER/3/2005 on Organization and Operational Procedure of the Ministry of Trade as already amended by Regulation of the Minister of Trade No. 30/M-DAG/PER/12/2005;
- 2. Regulation of the Minister of Trade No. 02/M-DAG/PER/2/2006 dated February 1, 2006 on Procedure of Export of Forestry Products;
DECIDES:
To stipulate:
REGULATION OF THE DIRECTOR GENERAL OF FOREIGN TRADE ONRULES AND PROCEDURE OF VERIFICATION/ TECHINCAL CHECK OF EXPORT OF CERTAIN WOOD PRODUCT BY SURVEYOR.
Article 1
Hereinafter referred to as:
- 1. Surveyor is a corporation having Surveyor's License (SIKUS) issued by the Ministry of Trade.
- 2. Certain Wood Product Included ;
- a. Product included in Ex. HS.4407 (S4S products, doorframes or window frames in S4S forms, doorframes or window frames in S4S form and end jointed);
- b. All wood products included in HS.4409;
- c. Products included in Ex. HS.4415 (palettes);
- d. Products included in Ex. HS.4418 (doorframes and window frames) and
- e. Prefabricated structures included in HS.9406.00.92.00.
Article 2
(1) The verification/technical check of export of certain wood products as meant in Article 1 must be implemented by a surveyor appointed by the Minister of Trade.
(2) For the verification/technical check as meant in paragraph (1), Registered Exporter of Forestry Products (ETPIK) must file a request to the surveyor within not later than three (3) days before date of verification to the surveyor in the form of Form of Request for Verification of Export Goods (PPBE) completed with:
- a. Photocopy of Certificate of ETPIK (only for first time export);
- b. Packing List (P/L);
- c. Invoices; and
- d. Photocopy of endorsement from Forestry Industry Revitalization Board (BRIK).
Article 3
Verification/technical check includes:
- a. Pre-verification: administrative verification of export document concerning:
- 1. Compliance of ETPIK certificate;
- 2. Compliance of endoresement.
- b. Verification: verification/technical check of export document concerning:
- 1. Quantity, type, mark, and package number;
- 2. Quantity of goods;
- 3. Type of wood;
- 4. Technical criteria as specified in Attachment II to Regulation of the Minister of Trade No. 02/M-DAG/PER/2/2006 on Procedure of Export of Forestry Products; and
- 5. Conformity of HS No.
- c. Post-verification:
- 1. Putting Surveyor's Identity (TPS) on packages that have been inspected;
- 2. Monitoring of loading of goods into containers, and sealing.
Article 4
(1) Result of verification/technical check of export of certain wood products implemented by surveyor shall be written on:
- a. Surveyor's Report (LS) in case that the inspected wood has been in accordance with the applicable regulations; or
- b. Report on Result of Verification (LHP) in case that the wood examined is not in accordance with the applicable regulations.
(2) LS or LHP shall be issued by the surveyor within not later than forty-eight (48) hours after completion of verification and or monitoring of loading into the containers.
(3) In case LS or LHP is not issued within the period as meant in paragraph (2), ETPIK may file a petition, in writing, to the Director General of Foreign Trade.
Article 5
(1) One (1) LS may only be used for one (1) complementary document of Export Manifest (PEB).
(2) ETPIK must submit photocopy of PEB to the surveyor within not later than two (2) days after it is given loading approval by the Directorate General of Customs and Excise.
Article 6
The surveyor must submit report on implementation of verification/technical check of export of certain wood products every month to the Director General of Foreign Trade, in this matter, the Director for Export of Agriculture and Forestry Products in the form of hard copy and electronic data.
Article 7
This Regulation is valid from the date it is stipulated.
